DEVLET MEMURLARI KANUNU
Kurum ve kuruluï¿½lar bu Kanuna gï¿½re ï¿½alï¿½ï¿½tï¿½rdï¿½klarï¿½ personele ait kadrolarda % 3 oranï¿½nda ï¿½zï¿½rlï¿½ ï¿½alï¿½ï¿½tï¿½rmak zorundadï¿½r. % 3ï¿½ï¿½n hesaplanmasï¿½nda ilgili kurum veya kuruluï¿½un (yurtdï¿½ï¿½ï¿½ teï¿½kilat hariï¿½) toplam dolu kadro sayï¿½sï¿½ dikkate alï¿½nï¿½r.
ï¿½zï¿½rlï¿½ler iï¿½in sï¿½navlar, ilk defa Devlet memuru olarak atanacaklar iï¿½in aï¿½ï¿½lan sï¿½navlardan ayrï¿½ zamanlï¿½ olarak, ï¿½zï¿½rlï¿½ kontenjanï¿½ aï¿½ï¿½ï¿½ï¿½ bulunduï¿½u sï¿½rece ï¿½zï¿½r gruplarï¿½ ve eï¿½itim durumlarï¿½ itibarï¿½yla sï¿½nav sorusu hazï¿½rlanmak ve ulaï¿½ï¿½labilirliklerini saï¿½lamak suretiyle merkezi olarak yapï¿½lï¿½r veya yaptï¿½rï¿½lï¿½r.
ï¿½zï¿½rlï¿½ personel ï¿½alï¿½ï¿½tï¿½rma yï¿½kï¿½mlï¿½ï¿½ï¿½nï¿½n yerine getirilmesinin takip ve denetimi ile ï¿½zï¿½rlï¿½lerin Devlet memurluï¿½una yerleï¿½tirilmesinden Devlet Personel Baï¿½kanlï¿½ï¿½ï¿½ sorumludur. ï¿½zï¿½rlï¿½ aï¿½ï¿½ï¿½ï¿½ bulunan kamu kurum ve kuruluï¿½larï¿½ bir sonraki yï¿½l iï¿½in alï¿½m yapacaklarï¿½ ï¿½zï¿½rlï¿½lere iliï¿½kin taleplerini her yï¿½lï¿½n Ekim ayï¿½nï¿½n sonuna kadar Devlet Personel Baï¿½kanlï¿½ï¿½ï¿½na bildirmek zorundadï¿½r. Devlet Personel Baï¿½kanlï¿½ï¿½ï¿½ kurum ve kuruluï¿½larï¿½n bildirimi ï¿½zerine, ï¿½zï¿½rlï¿½ kontenjanlarï¿½na yerleï¿½tirme yapabilir veya yaptï¿½rabilir. ï¿½zï¿½rlï¿½lerin memurluï¿½a alï¿½nma ï¿½artlarï¿½na, merkezi sï¿½nav ve yerleï¿½tirmenin yapï¿½lmasï¿½na, eï¿½itim durumu ve ï¿½zï¿½r gruplarï¿½ dikkate alï¿½narak kura usulï¿½ ile yapï¿½lacak yerleï¿½tirmelere, ï¿½zï¿½rlï¿½lerin gï¿½revlerini yï¿½rï¿½tmelerinde hangi yardï¿½mcï¿½ araï¿½ ve gereï¿½lerin kurumlarï¿½nca temin edileceï¿½ine, kamu kurum ve kuruluï¿½larï¿½nca ï¿½zï¿½rlï¿½ personel istihdamï¿½ ile ilgili istatistiksel verilerin bildirilmesine iliï¿½kin usul ve esaslar ile diï¿½er hususlar ï¿½zï¿½rlï¿½ler ï¿½daresi Baï¿½kanlï¿½ï¿½ï¿½nï¿½n gï¿½rï¿½ï¿½ï¿½ alï¿½narak Devlet Personel Baï¿½kanlï¿½ï¿½ï¿½nca hazï¿½rlanacak yï¿½netmelikle dï¿½zenlenir.
Gï¿½nlï¿½k ï¿½alï¿½ï¿½ma saatlerinin tesbiti: Madde 100 ï¿½ Gï¿½nlï¿½k ï¿½alï¿½ï¿½manï¿½n baï¿½lama ve bitme saatleri ile ï¿½ï¿½le dinlenme sï¿½resi, bï¿½lgelerin ve hizmetin ï¿½zelliklerine gï¿½re merkezde Baï¿½bakanlï¿½k Devlet Personel Baï¿½kanlï¿½ï¿½ï¿½nï¿½n teklifi ï¿½zerine Bakanlar Kurulunca, illerde valiler tarafï¿½ndan tesbit olunur.

Ancak ï¿½zï¿½rlï¿½ler iï¿½in; ï¿½zï¿½r durumu, hizmet gerekleri, iklim ve ulaï¿½ï¿½m ï¿½artlarï¿½ gï¿½z ï¿½nï¿½nde bulundurulmak suretiyle gï¿½nlï¿½k ï¿½alï¿½ï¿½manï¿½n baï¿½lama ve bitiï¿½ saatleri ile ï¿½ï¿½le dinlenme sï¿½releri merkezde ï¿½st yï¿½netici, taï¿½rada mï¿½lki amirlerce farklï¿½ belirlenebilir. Gï¿½nï¿½n 24 saatinde devamlï¿½lï¿½k gï¿½steren hizmetlerde ï¿½alï¿½ï¿½ma saat ve usulï¿½nï¿½n tesbiti: Madde 101 ï¿½ (Deï¿½iï¿½ik: 132/20116111/105 md.) Gï¿½nï¿½n yirmidï¿½rt saatinde devamlï¿½lï¿½k gï¿½steren hizmetlerde ï¿½alï¿½ï¿½an Devlet memurlarï¿½nï¿½n ï¿½alï¿½ï¿½ma saat ve ï¿½ekilleri kurumlarï¿½nca dï¿½zenlenir. Ancak, kadï¿½n memurlara; tabip raporunda belirtilmesi hï¿½linde hamileliï¿½in yirmidï¿½rdï¿½ncï¿½ haftasï¿½ndan ï¿½nce ve her hï¿½lde hamileliï¿½in yirmidï¿½rdï¿½ncï¿½ haftasï¿½ndan itibaren ve doï¿½umdan sonraki bir yï¿½l sï¿½reyle gece nï¿½beti ve gece vardiyasï¿½ gï¿½revi verilemez. ï¿½zï¿½rlï¿½ memurlara da isteï¿½i dï¿½ï¿½ï¿½nda gece nï¿½beti ve gece vardiyasï¿½ gï¿½revi verilemez.
